SUMMONS BY PUBLICATION

Whereas, on January 15, 2016, a Petition was filed before this Court, which reads as follows:
1.       That petitioner is of legal age, Filipino citizen, married to Paul Reynold P. Lomuntad and a resident of Brgy. 6, San Julian, Batac City, Ilocos Norte, Philippines, while respondent is her husband, likewise of legal age, Filipino citizen, married and whose last known address is at 117 P. Manahan St., Pasay City, Philippines, where he may be served with court processes;
2.     That petitioner was then a working student when she came to know the respondent who was then her classmate in college of law in Manila;
3.      That they became close to one another and later became sweethearts;
4.     That when respondent transferred to another school, petitioner and respondent maintained their romantic relationship until they decided to be getting married on February 9, 1996 at Quezon City Hall, a certified true copy of their marriage contract is hereto attached as Annex “A”;
5.     That after their marriage, petitioner and respondent lived together as husband and wife in an apartment in Pasay City. They lived a blissful married life. However, petitioner discovered that respondent was a controlling husband. He imposed rigid rules but petitioner followed his orders out of love and respect;
6.     That petitioner likewise discovered that respondent manifested dependency on several matters that petitioner has to exert extra effort to help respondent in his studies;
7.     That during their cohabitation, they begot a child named, FRANCIS RUIZ LOMUNTAD, born on January 1, 1997, a certified true copy of his birth certificate is hereto attached as Annex “B”;
8.     That after her graduation, petitioner continued working at the Department of Energy while respondent’s dependency became worse but she remained supportive. Every six months, she would enroll respondent for a Civil Service Review Class but he flunked so many times. Respondent’s career did not work at well in Manila until they decided to move to the home province of respondent to have a better chance of employment;
9.     That long after the birth of their son, respondent found work as administrator of a local college in Samar. Respondent would leave Manila every week for the first month and twice on the second month of his being employed there. Their plan was for respondent to settle down and adjust to life in Samar until such time that they would relocate thereat to raise their family;
10.  That petitioner found out later that their plan would not materialize for about two months that respondent started working in the province, he met his former girlfriend and started seeing her regularly and with whom he got sexually involved that respondent would be spending every night at her house;
11.    That thinking about the welfare of their son, petitioner endured the ordeal of having a third party in their marriage and accepted the fact that respondent was seeing another woman in his place;
12.  That when things became more serious to the point that respondent has to choose between petitioner and the other woman, petitioner never wanted to give up just for the sake of being his wife in Manila while the other woman would be respondent’s companion in Samar.
13.   That after two months, respondent arrived in Manila informing the petitioner that he married his ex-girlfriend. That petitioner was devastated. She felt insulted and violated.
14.  That in the year 2000, petitioner and respondent parted ways especially so because respondent stopped seeing petitioner and their child. Respondent likewise stopped providing support for his family;
15.  That in the year 2004, petitioner moved to Laoag City to start a new life and raise her son alone even without the support of respondent;
16.  That the relationship between petitioner and respondent was estranged in the year 2004 and they stopped communicating with each other;
17.  That the marriage between petitioner and respondent is void from the beginning for the reason that at the time petitioner and respondent contracted marriage, respondent was psychologically incapacitated to perform his marital obligations and such incapacity became manifest only after the celebration of their marriage;
18.  That petitioner and respondent are obliged under the law to observe mutual love, respect and fidelity and render mutual help and support, materially, socially and spiritually bjut these are the essential obligations of marriage which the respondent failed and in incapable of performing or fulfilling;
19.  That respondent was remiss in the performance of his marital obligations to render mutual help and support to observe mutual love, respect and fidelity;
a.     He is unfaithful. He cannot maintain a lasting relationship. He got involved with extra-marital affair that brought emotional torment and insult to his wife;
b.     He is self-centered and egocentric individual. He manifested lack of interest in fulfilling his duties as a husband and a father to their child. No feeling of guild was ever manifested by him in spite of his wrongdoings. He would never accept any fault;
c.      He is irresponsible. He was totally dependent for financial support upon his wife by manipulating her. He lacks future planning. He abandoned his marital and paternal obligations;
d.     He is self-righteous and evasive. He avoids his responsibilities by avoiding their marital issues and as a result all the marital responsibilities were left on petitioner shoulder;
20.The malady and mental disposition of the respondent has seriously and effectively prevented petitioner and respondent from having a functional normal marital life that would be conducive to bringing up a healthy personal inter-marital relationship within the family and which is necessary for its growth.
21.  That respondent’s continuing non fulfillment of his marital obligations finally destroyed the integrity and wholeness of their marriage;
22. That respondent’s psychological incapacity to perform the essential marital obligations is due ot the fact that he is suffering from a Narcissistic Personality ?Disorder with underlying Antisocial and Dependent Personality Traits which is grave. Incurable and deeply rooted and would persist over time resulting in a Partner Relational Problem in their marriage;
23. That petitioner and respondent do not have conjugal properties and neither do they have conjugal obligations;
24.That petitioner is constrained to file this action to free herself from the inequity of being bound by a marriage to a husband who only cares for himself and has totally neglected his marital and parental obligations.

WHEREFORE, it is respectfully prayed of this Honorable Court that the marriage between petitioner and respondent be declared null and void in accordance with Article 36 of the Family Code of the Philippines and Executive Order No. 209 as amended by Executive Order No. 227

NOW THEREFORE, pursuant to Sec. 15, Rule 14 of the 1997 Rules of Civil Procedure, the herein respondent Paul Reynold P. Lomuntad is hereby given sixty (60) days from the last publication of this Summons within which to answer the complaint. Summons should be published in a newspaper of general circulation in the Philippines at the expense of petitioner Virgie Ines Ruiz Lomuntad.

Pagudpud’s tourism transformer passes away

Ricardo Nolasco Jr., owner of Hannah’s Beach Resort and Convention Center in Pagudpud, Ilocos Norte passed away on Wednesday evening, July 11, 2018.
